The EU AI Act (Regulation (EU) 2024/1689) treats an AI system used as a safety component of machinery as high-risk. That covers anything deciding a machine's stop/start, governing a robot's action, or flagging a defect as a safety function. Transparency obligations apply from 2 August 2026, and the high-risk obligations for AI embedded in regulated products such as machinery carry an extended transition to 2 August 2027. The Commission's proposed Digital Omnibus may adjust parts of this timetable. It is still in the legislative process, so we design to the current statutory dates and track the amendments. Running in parallel, the Machinery Regulation (EU) 2023/1230 applies from 20 January 2027 and pulls safety components with self-evolving machine-learning behaviour, and machinery with embedded AI performing safety functions, into its high-risk Annex I. Both require third-party notified-body assessment, with no self-certification route. That conformity work adds cost and lead time, which is exactly why designing for it early is a commercial decision, not just a legal one.
Governance & compliance
GDPR sits underneath all of it. Manufacturing IoT, floor cameras, operator-facing sensors, and monitoring systems routinely capture personal data: employee images, timestamps, device-to-user linkage. Missing Article 30 records of processing and an unclear retention policy are the common enforcement gaps, with exposure up to the higher of €20 million or 4% of global annual turnover. Malta is our home base and a practical advantage here. The MDIA has regulated technology arrangements since its 2018 establishment and is Malta's designated market-surveillance authority for the EU AI Act, while the AI Act itself gives SMEs priority, free-of-charge access to national regulatory sandboxes (Article 58). The Digitalise Your SME scheme offers up to €128,000 at 50% co-funding (60% in Gozo), with a +10% AI top-up via the MDIA for AI projects, though it runs in time-limited calls, so the live window has to be checked before you plan around it. We treat Malta and the wider EU market as equal ground: the same EU rulebook governs a factory in Birżebbuġa and one in Bavaria.
